How Much Do the Best Civilian Court Martial Lawyers Cost?

The best civilian court martial lawyers don’t come cheap.  Depending on the complexity of the case and the UCMJ charge (a sexual assault charge defense, for example, will generally be more complex than, say, a drug-use defense), the best court martial lawyers will likely charge anywhere from $40,000 to well over $100,000.  This can be a life altering amount of money for many military service members and their families.  Worse yet, it may be unaffordable for some, which is especially scary considering the oft cited line: “A jury consists of twelve persons chosen to decide who has the better lawyer.”

A military law trial consultant may be the answer.

What Does a Court Martial Trial Consultant Do?

A court martial trial consultant works hand in hand with your active-duty military defense counsel to investigate and prepare your case for trial.  Essentially, the trial consultant brings their experience, skill, and expertise to the military accused’s case and ensures that the detailed military defense counsel is prepared for all in-court matters in a superior way.  Working closely with an accused service member’s detailed military attorney, the trial consultant assists in:

  • Investigating the Case (identifying strengths and weaknesses)
  • Developing an Overall Trial Strategy
  • Developing a Case Theme & Theory
  • Identifying Expert Witness Needs (e.g., Forensics, DNA, False Confession)
  • Interviewing Witnesses
  • Preparing Witnesses for Direct Examination
  • Preparing for Cross Examination
  • Conducting Legal Research & Writing Pretrial Motions
  • Preparing the Accused Service Member to Testify
  • Preparing Voir Dire Questions for the Members (Jury) Pool
  • Preparing Defense Evidence, Exhibits, and Trial Aids
  • Preparing Opening & Closing Statements

The result is that an accused service member can get the benefit of retaining a seasoned civilian defense attorney, but at a savings of 50 to 75 percent.  That’s the value.  At the same time, the trial consultant’s efforts substantially reduce the detailed defense counsel’s workload, allowing for their increased focus on critical trial performance areas.
